1. Agreement to Terms

By using any myKokoro application or service ("our Apps"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Apps.

2. Description of Service

myKokoro provides mobile applications designed as organizational, planning, and record-keeping tools for health and animal care management.

3. Not a Substitute for Professional Advice

Our Apps are organizational and informational tools only. They do not provide professional advice, diagnosis, or treatment recommendations of any kind — whether medical, veterinary, psychological, legal, or financial. Users are solely responsible for any decisions made based on information stored or displayed in our Apps. Always consult a qualified professional for advice relevant to your situation.

myKokoro applications are record-keeping and organizational tools only. They are not medical devices, veterinary tools, or diagnostic applications. No information stored or displayed in these Apps should be interpreted as medical or veterinary advice, diagnosis, or treatment. Do not use these Apps as a substitute for professional medical or veterinary care.

4. Export, Sharing, and Emergency Features

Important: The export and sharing features within our Apps are provided as a convenience tool only. myKokoro is not responsible for failed transmissions, delivery failures, undelivered messages, or any consequences arising from reliance on shared records in emergency or non-emergency situations. Do not use this App as your sole means of communicating in a medical or veterinary emergency. Always contact emergency services directly by calling 911 or your local emergency number.

The "Lost Mode" and emergency sharing features are informational convenience tools only. myKokoro does not guarantee that any shared link, broadcast, or notification will be received, opened, or acted upon by any recipient, including veterinarians, shelters, or emergency services. myKokoro is not liable for any outcome resulting from the use or failure of these features.

5. Notification and Reminder Reliability

Reminders and notifications depend entirely on your device settings, operating system, and network conditions. myKokoro does not guarantee the delivery of any reminder or notification and is not liable for missed medications, appointments, vaccinations, or other events resulting from notification failures, device settings, or any other cause. You are solely responsible for independently tracking and managing all health-related schedules for yourself and your animals.

6. User Responsibility for Data Accuracy

You are solely responsible for the accuracy and completeness of all data entered into our Apps. You agree that myKokoro is not liable for any errors, omissions, or incorrect information entered by you or any third party you invite to access your data. You are responsible for verifying all information, calculations, or reminders before relying on them for any purpose.

7. Professional Use

If you use our Apps in a professional capacity, you are solely responsible for ensuring your use complies with your professional licensing requirements, ethical standards, and all applicable laws and regulations.

8. Subscriptions and Payments

Some of our Apps offer subscription plans with various features and pricing tiers. All subscriptions and payments are processed and managed exclusively through the Apple App Store or Google Play Store. myKokoro does not store or have access to your credit card or financial billing information.

Subscription Terms:

  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage your subscription and turn off auto-renewal by going to your device's Account Settings after purchase
  • Current pricing is available in the App Store or Google Play Store for your region
  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase

Free Trials (if applicable):

  • If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription
  • At the end of the free trial period, your subscription will automatically begin and you will be charged unless you cancel at least 24 hours before the trial ends

Cancellation:

  • You may cancel your subscription at any time through your Apple ID Account Settings (iOS) or Google Play Store Account Settings (Android)
  • Cancellation takes effect at the end of the current billing period
  • No refunds will be provided for partial billing periods

Refunds:

  • All refund requests must be made through the Apple App Store or Google Play Store in accordance with their respective refund policies
  • myKokoro does not have the ability to issue refunds directly as we do not process payments

9. Supported Organizations

myKokoro may voluntarily donate a portion of subscription proceeds to independent third-party organizations, including but not limited to DAWGS Prison Program and Strays No More of Schuylkill County. These donations are entirely voluntary charitable contributions made at myKokoro's sole discretion. myKokoro may offer referral programs where specific donations are triggered by the use of a designated partner code at the time of subscription.

Important Disclaimer Regarding Supported Organizations: DAWGS Prison Program and Strays No More of Schuylkill County are independent nonprofit organizations. They have no involvement in, affiliation with, control over, or responsibility for the development, operation, content, or services of any myKokoro application or website. Neither organization bears any legal liability for any aspect of myKokoro's products, services, or operations. The relationship between myKokoro and each of these organizations is that of donor and recipient only. They are not legal partners, joint venturers, co-developers, or affiliates of myKokoro or Visualize Change Digital in any capacity.

10. Invite Codes and Shared Access

For Apps that allow shared data access via invite codes or email, you are responsible for managing who has access to your data. myKokoro is not liable for unauthorized data access, deletion, or modification resulting from your sharing of credentials or invite codes.

11. Limitation of Liability

Our Apps are provided "as is" and "as available" without warranties of any kind, express or implied. myKokoro is not liable for any loss or corruption of data, service interruptions, notification failures, export or transmission failures, or any direct, indirect, incidental, or consequential damages arising from the use of our Apps. In no event shall myKokoro's total liability exceed the amount you have paid for the applicable App in the twelve (12) months preceding a claim.

12. Governing Law

These terms are governed by the laws of the United States and the Commonwealth of Pennsylvania.
